HONG KONG TOURISM BOARD PRIZE COMPETITION TERMS AND CONDITIONS

  1. The “Discover your Hong Kong” promotion (referred to as the “Prize Competition”) is organised by the Hong Kong Tourism Board (“Promoter”) of 20 Orange Street, London, WC2H 7EF, United Kingdom.
  2. The “Prize Sponsor” is Shangri-La The Shard, London, 31 St Thomas Street, London SE1 9QU United Kingdom.
  3. The Prize Competition is open to residents of Great Britain aged 18 and over. It is not open to residents of Northern Ireland, Republic of Ireland, Channel Islands or any other country or territory outside of Great Britain.
  4. No purchase is necessary to enter or win and no charge will be made for any website registration required to enter.
  5. The Prize Competition is not open to employees, agencies, partners or suppliers (or their associated group companies) of the Promoter or Prize Sponsor, or to family members, friends or anyone else connected to foregoing. The Promoter may require proof of entrants’ eligibility at any time.
  6. Entries to the Prize Competition are subject to these terms and conditions (“Terms”) and to any specific terms and mechanics of the Prize Competition provided by the Promoter or the Prize Sponsor at the time of entry.
  7. To enter the Prize Competition, you must enter your details via the HKTB Competitions & Promotions Site at https://ukpromotion.discoverhongkong.com/uk/.   8. Only one entry may be made per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed. Neither the Promoter nor the Prize Sponsor shall be liable for entries that are lost, delayed, misdirected or incomplete, that cannot be delivered or entered for any technical or other reason, or a false or incorrect email address submitted by the entrant.
  9. By entering the Prize Competition, entrants confirm that any content or material submitted by them upon entering the Prize Competition or thereafter has been submitted voluntarily and gives permission for the Promoter and the Prize Sponsor to publish the same through their social media, website, eNewsletter and/or any printed materials.
  10. All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned. By submitting your competition entry and any accompanying material, you agree to assign to the Promoter all your intellectual property rights with full title guarantee and waive all moral rights in and to your competition entry, and otherwise arising in connection with your entry, to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
  11. The prize competition opens 2nd December 2021 and closes on the 15th January 2022. All times and dates stated in relation to a Prize Competition are based on UK time unless specified otherwise. Entries received after the stated closing date and time of the Prize Competition will not be considered. The Promoter will not accept competition entries that are automatically generated by computer, completed by third parties or in bulk, illegible, have been altered, reconstructed, forged or tampered with, are (where relevant) photocopies and not originals; or are incomplete.
  12. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.
  13. Winner Selection and Prize Details

  14. Four winners (each a “Prize Winner”) will be picked at random using a computer process from all the valid entries. The draw will take place within 7 days of the closing date.
  15. The prize will be limited to that set out in the Promoter’s description of the Prize Competition (“Prize”).
  16. All elements of the Prize are non-exchangeable, non-transferable, and not redeemable for cash or other prizes. The Prize cannot be used in conjunction with other offers, promotions or prizes. There is no alternative to the Prize save that the Promoter and Prize Sponsor shall have the right to substitute or amend the Prize with another prize of similar value (i) in the event the Prize is not available or (ii) if either of them considers it necessary or appropriate to do so.
  17. Additional Prize Conditions

  18. Following closure of the Prize Competition, the Prize Winner will be notified, using the contact details provided with the entry, and given details of how to claim the Prize. The Promoter reserves the right to refuse to amend any contact information once an entry has been made.
  19. Prize winners who do not contact the Promoter (or, as applicable, the Prize Sponsor) within 14 days after the notification is sent will forfeit their right to the Prize and the Promoter and Prize Sponsor shall be entitled to select another Prize Winner. That subsequent Prize Winner will have to respond to notification within 7 days of it being sent or they will also forfeit the prize.
  20. Once the Prize Winner has responded within the required time frame and accepted the Prize, the Prize and any element of it will be non-exchangeable, non-transferable and not negotiable.
  21. Any Prize which includes travel may be subject to reasonable limitations notified subsequently by the Promoter or Prize Sponsor, including requirements to book travel within a specified period and blackout or excluded dates where travel is not available. Such Prizes will also be subject to normal booking conditions of the Prize Sponsor or its agents.
  22. Any costs and expenses which are not specifically included in the Prize description (which may include domestic travel, food and drink, incidental expenses, gratuities, etc.) or provided for in these Terms are excluded and will be the sole responsibility of the Prize Winner.
  23. Accommodation/Food & Beverage

  24. Except where expressly stated in the Prize description, any accommodation, as well as any food and beverage elements of the Prizes are inclusive of taxes, fees and related local charges
  25. Prizes are subject to availability, to the hotel’s terms and conditions and to any embargoed blackout dates specified.
  26. First Prize Additional Conditions

  27. First prize comprises a voucher for an overnight stay for 2 people at Shangri-La The Shard, London with breakfast and a 3 course dinner with wine pairings at TĪNG Restaurant, and is subject to the following additional conditions:
    1. The voucher may only be redeemed once, may not be exchanged for cash or replaced if lost, is non-transferable and non-refundable;
    2. The voucher is valid for stays until 15th July 2022, must be used within the stated validity period and the Prize Sponsor will not permit any extension past this date;
    3. Accommodation must be booked in advance, quoting the voucher ID reference and the voucher must be presented upon arrival at the hotel;
    4. The voucher will be valid for midweek stays only, Sunday – Thursday; Accommodation is subject to availability at the time of reservation enquiry, to blackout dates and exclusions, and must be booked a minimum of 2 days prior to arrival;
    5. The voucher will not be valid in conjunction with other offers or promotions of the Prize Sponsor or of any third party and is not eligible for GC award points;
    6. A credit card must be presented during check in along with any documentation required by the hotel. The hotel has the right to refuse check-in should the guest fail to provide necessary documentation;
    7. Cancellations can be made until 4pm local hotel time on the day prior to arrival. After this time, or for any non-arrival, the Prize will be forfeit;
    8. Access to restaurants, bars, spa, swimming pools, health club and other hotel facilities are subject to the guidelines of local government authorities; and
    9. The Prize Sponsor reserves the right to unilaterally amend or add to the terms & conditions of its offer.

    Second Prize Additional Conditions

  28. Second prize comprises a voucher for a luxury Seasonal Champagne Afternoon Tea for 2 at TĪNG Restaurant at Shangri-La The Shard, London, and is subject to the following additional conditions:
    1. The voucher may only be redeemed once, may not be exchanged for cash or replaced if lost, is non-transferable and non-refundable;
    2. The voucher is valid until 15th July 2022, must be used within the stated validity period and the Prize Sponsor will not permit any extension past this date;
    3. The voucher will be valid for bookings between Monday – Thursday 12-4pm, is subject to availability at the time of reservation enquiry, to blackout dates and exclusions, and must be booked a minimum of 24 hours in advance, quoting the gift voucher ID reference. Window seats are not guaranteed;
    4. The voucher will not be valid in conjunction with other offers or promotions of the Prize Sponsor or of any third party and is not eligible for GC award points;
    5. Access is subject to the guidelines of local government authorities; and
    6. The Prize Sponsor reserves the right to unilaterally amend or add to the terms & conditions of its offer.

    Third Prize Additional Conditions

  29. Third prize comprises a voucher for a Sky Brunch for 2 at Sky Lounge in partnership with Veuve Clicquot at Shangri-La The Shard, London, and is subject to the following additional conditions:
    1. The voucher may only be redeemed once, may not be exchanged for cash or replaced if lost, is non-transferable and non-refundable;
    2. The voucher is valid until 15th July 2022, must be used within the stated validity period and the Prize Sponsor will not permit any extension past this date;
    3. The voucher will be valid only on Sundays during allocated booking slots, is subject to availability at the time of reservation enquiry and to blackout dates and exclusions, and must be booked a minimum of 24 hours in advance, quoting the gift voucher ID reference. Window seats are not guaranteed;
    4. If Sky Brunch is not available, another experience will be offered to the same value. Prize consists of a welcome glass of Veuve Clicquot Yellow Label, selection of starters, choice of 1 main course each & dessert platter;
    5. The voucher will not be valid in conjunction with other offers or promotions of the Prize Sponsor or of any third party and is not eligible for GC award points;
    6. Access is subject to the guidelines of local government authorities; and
    7. The Prize Sponsor reserves the right to unilaterally amend or add to the terms & conditions of its offer.

    Fourth Prize Additional Conditions

  30. Fourth prize comprises a voucher for cocktails for 2 at GONG Bar at Shangri-La The Shard, and is subject to the following additional conditions:
    1. The voucher may only be redeemed once, may not be exchanged for cash or replaced if lost, is non-transferable and non-refundable;
    2. The voucher is valid until 15th July 2022, must be used within the stated validity period and the Prize Sponsor will not permit any extension past this date;
    3. The voucher will be valid only on Wednesday, Thursday and Sunday, subject to availability at the time of reservation enquiry and to blackout dates and exclusions, and must be booked a minimum of 24 hours in advance, quoting the gift voucher ID reference. Window seats are not guaranteed;
    4. Prize consists of 2 signature cocktails per person (4 in total); and
    5. The voucher will not be valid in conjunction with other offers or promotions of the Prize Sponsor or of any third party and is not eligible for GC award points;
    6. Access is subject to the guidelines of local government authorities; and
    7. The Prize Sponsor reserves the right to unilaterally amend or add to the terms & conditions of its offer.

    Handling of Personal Data

  31. Information on how entrants’ personal data may be used by the Promoter is available in the Promoter’s Privacy Policy, which can be accessed at https://www.discoverhongkong.com/uk/about-hktb/privacy-policy.jsp.
  32. Without limitation, entrants’ personal data collected by the Promoter may be shared with the Prize Sponsor for the purposes explained in these Terms and/or processed by the Prize Sponsor on behalf of the Promoter in order to administer the Prize Competition and facilitate delivery of the Prize.
  33. Where data is shared by the Promoter with the Prize Sponsor as an independent data controller, the Prize Sponsor will determine the legal basis for any use of entrants’ personal data. Entrants should consult the Prize Sponsor to understand how their personal data may be used.
  34. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and county of residence of major prize winners (and, if applicable copies of their winning entries) to anyone who emails lonwwo@hktb.com or writes to the Promoter (enclosing a self-addressed envelope) within one month after the closing date of the Prize Competition.
  35. If you object to any or all of your surname and county being published or made available, please contact the Promoter by email to lonwwo@hktb.com or by correspondence to the address given above. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
  36. The Prize Winner and any companion may be required to participate in reasonable publicity and marketing activity as a condition of receiving the Prize. These activities (the “Publicity”) include but are not limited to:

    - Social Media
    - Website Communications
    - Photography
    - Video or Film Recordings
    - Audio Recordings
    - Email Marketing

    The Prize Winner acknowledges that the Promoter and Prize Sponsor have the right to use such Publicity in any medium and in any reasonable manner. Should any companion be required to take part in the stated promotional activity, express written consent to Publicity be sought by the Promoter and Prize Sponsor, and the Prize Winner acknowledges that receipt of this consent may be a condition to receiving or enjoying the continued benefit of the Prize.
  37. Liability

  38. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
  39. Additional Terms

  40. The decisions of the Promoter and Prize Sponsor in all matters in relation to the Prize Competition are exercised at their absolute discretion, shall be final and binding and no correspondence will be entered into.
  41. Unless expressly provided in any supplementary competition terms, this Prize Competition is in no way sponsored, endorsed or administered by, or associated with, any social media platform including Twitter, Facebook or Instagram. You are providing your information to the Promoter or Prize Sponsor (as applicable), and not to Twitter, Facebook or Instagram. To the extent permissible by law you hereby release Twitter, Facebook and Instagram from any liability arising from this Prize Competition and your participation in it. Any questions, comments or complaints regarding this Promotion must be directed to the Promoter only, and not to Twitter, Facebook, Instagram or other social media platform.
  42. The Promoter reserves the right at any time and from time to time to modify or temporarily or permanently discontinue this Prize Competition with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud) or if the Promoter considers it necessary or advisable to do so in its sole discretion.
  43. The Prize Competition, these terms and conditions and any dispute arising in connection with them will be governed by English law and will be subject to the exclusive jurisdiction of the courts of England and Wales.
